Alcohol Policy (Draft 11-08-07)

The Board of Trustees of the Unitarian Universalist Congregation of Duluth has adopted an alcohol policy that allows for the responsible and legal use of alcoholic beverages. This policy is intended to ensure that the consumption of alcohol is done safely, responsibly, and in keeping with laws of the City of Duluth, the State of Minnesota.
The UUCD neither encourages the use of alcohol nor tolerates the abuse of alcohol. Any use of alcohol must be managed in a way that respects the rights of those who choose not to consume. Use of alcohol must be characterized by care, responsibility, and accountability.
- SELLING alcoholic beverages (cash bar): Alcoholic beverages may be sold at any UUCD sponsored event whether the event takes place on or off church property under the following conditions:
- If UUCD is the seller, the appropriate City of Duluth temporary on-sale license must be obtained. The event coordinator must submit an application for a temporary license to the City Clerk at least two months before such an event. Please note that the UUCD is limited to 12 one day licenses within a 12 month period and only one license per 30 day period. Minnesota Statutes Section 340A.410, Subd. 10. Alcohol must be obtained from a licensed wholesale distributor rather than from a retail off-sale establishment. It is unlawful for a retail licensee to sell alcoholic beverages to any person who intends to resell the alcoholic beverages. Minnesota Statutes Section 340A.505. The temporary license may provide that the licensee may contract for intoxicating liquor catering services with the holder of a full-year on-sale intoxicating liquor license. Minnesota Statutes Section 340A.404, Subd. 10(a)
- UUCD may contract with the holder of a state caterer's permit for the sale of intoxicating liquor which is an incidental part of a food service. The caterer is to be hired to provide a food service as well as the intoxicating liquor. Caterer's permits are issued by the State of Minnesota to restaurants that hold an on-sale intoxicating liquor license. Minnesota Statutes Section 340A.404, Subd. 12.
- SERVING alcoholic beverages at UUCD sponsored events (open bar): Alcohol cannot be served without a license if payment has been made for food or for entrance to the event. This would constitute the indirect sale of alcohol and is prohibited by Minnesota statute and City code. If the event involves a fee for either the food or the admission, two options are available: 1) hire a caterer that has a state issued caterer's permit as provided in paragraph 1B of this policy; or 2) get a temporary license as provided in paragraph 1A of this policy.
- SERVING alcoholic beverages at non-UUCD sponsored events: Alcoholic beverages may be served when facilities are being used by persons at an event not sponsored by UUCD. The event sponsor or host shall comply with all applicable city codes and state laws related to alcoholic beverages. The event sponsor shall provide a signed UUCD "Contract for Use of Facilities" agreement with the "hold harmless" clause before the event.
- BYOB events: At a social event sponsored by UUCD, whether the event takes place on or off church property, and whether a charge is made for admission or the event is admission free, persons in attendance may consume their own alcoholic beverages if a one-day consumption and display permit has been acquired from the City. The application for the permit is available on-line at the State Commission of Public Safety web-site. The application should be filed with the City Clerk two months prior to the event to accommodate the City's approval process. Please note that the City may only issue 10 such permits in any one year. Minnesota Statutes Section 340A.414, Subd. 9.

- Alcoholic beverages must be distributed by an adult rather than self-serve.
- Such designated servers must be willing to refuse service when they determine a person appears to be intoxicated.
- Under no circumstance may persons under the age of twenty-one consume alcohol, even when accompanied by their parents.
Definition: The term "alcoholic beverages" shall include "alcoholic beverages", "intoxicating liquor", "malt liquor", "3.2 percent malt liquor" and "wine" as those terms are defined by Duluth City Code Chapter 8, Section 13.
